Terms of Use

Rules that apply to all use of the website, your account area and community features.

1. Purpose

These Terms of Use (“ToU”) set out the rules governing access to and use of the website https://www.cmay-collections.com (hereinafter “the Site”), published by CMAY COLLECTIONS.

Accessing the Site and using its features implies full and unreserved acceptance of these Terms of Use. For purchases, please refer to the Terms of Sale.

2. Access to the Site

Access to the Site is free of charge. Any equipment, connection and communication costs are borne solely by the user.

The Site is accessible 24/7, except in the event of interruption for maintenance, updates or force majeure. CMAY COLLECTIONS cannot be held liable for any interruptions, slowdowns or unavailability of the Site.

3. Creating an account

Creating an account is optional for browsing the Site, but required to access features such as:

  • order history and shipment tracking;
  • the wishlist;
  • the CMay Coins loyalty programme;
  • the referral programme;
  • your personal CardDex (coming soon);
  • participation in the community.

The user undertakes to provide accurate, complete and up-to-date information, and to keep it current should anything change. Account creation is reserved for adult individuals. For minors, registration requires the consent of a legal guardian.

4. Account security

The user is solely responsible for keeping their login and password confidential. Any use of the account is deemed to have been carried out by the user.

If unauthorised access is suspected, the user must change their password immediately and notify CMay Collections at support@cmay-collections.com.

5. Expected conduct

The user undertakes to:

  • comply with applicable laws;
  • not infringe the rights of third parties (intellectual property, privacy, image);
  • not post any unlawful, defamatory, insulting, racist, hateful or pornographic content, or content that undermines human dignity;
  • not disrupt the operation of the Site (intrusion, mass scraping, denial of service, circumvention of technical security measures);
  • not create multiple accounts with the intent of circumventing the limits of the loyalty or referral programme;
  • not use the Site for unauthorised commercial purposes.

6. User content

The user remains the owner of the content they post (comments, reviews, photos, contributions). They nonetheless grant CMay Collections a non-exclusive, royalty-free, worldwide licence to use, reproduce and adapt that content for the needs of the Site (display, moderation, archiving), for the legal duration of the rights.

The user warrants that they hold all rights necessary to the content they post, and indemnifies CMay Collections against any third-party claim in this respect.

7. Moderation

CMay Collections reserves the right to moderate published content after the fact and to remove, without notice, any content that breaches these Terms of Use or the law.

Any report of unlawful content may be sent to contact@cmay-collections.com pursuant to Article 6 I-5 of the French LCEN (see Legal Notice).

8. Account suspension and deletion

In the event of a breach of these Terms of Use, CMay Collections may, without notice and without compensation, suspend or delete the user’s account. Any associated benefits (CMay Coins, ongoing referrals) will then be lost.

The user may request the deletion of their account at any time from their personal area or by email at dpo@cmay-collections.com.

9. Intellectual property

All elements of the Site are protected by copyright, trademark law and database rights. Any unauthorised reproduction, representation or exploitation is prohibited.

10. Liability

CMay Collections makes every effort to provide accurate, up-to-date information. CMay Collections cannot be held liable for any error, omission, delay or technical unavailability. The Site may contain links to third-party sites that CMay Collections does not control and whose practices may differ.

11. Personal data

The processing of personal data is described in the Privacy Policy.

12. Changes to these Terms of Use

CMay Collections reserves the right to amend these Terms of Use at any time. Users are informed of any changes by any appropriate means (banner, email). Continued use of the Site after a change constitutes acceptance of the new Terms of Use.

13. Governing law

These Terms of Use are governed by French law. Any dispute relating to their interpretation or performance falls within the jurisdiction of the French courts.
